b. Non-Confidentiality of Your UGC: Your UGC will be considered non-confidential and non-proprietary, regardless of whether you mark them "confidential," "proprietary," or the like. Ungjin does not assume any obligation to you or any third-party with respect to your UGC. You are responsible for the authenticity of your UGC and for ensuring compliance with these Terms and any applicable laws.

c. Unsolicited Ideas and Materials: Please refrain from sending unsolicited ideas or materials. Any such Unsolicited Ideas and Materials will be considered UGC and subject to the terms here. Ungjin retains the rights to use these Unsolicited Ideas and Materials as Ungjin sees fit.

d. License to Your UGC: You grant Ungjin a non-exclusive, unrestricted, unconditional, worldwide, irrevocable, perpetual, and cost-free license to use, distribute, reproduce, and exploit your UGC. This includes the right to modify and create derivative works from your UGC for any purpose. You consent to the removal or alteration of metadata or copyright management information in your UGC. You waive any moral rights you may have in your UGC, to the extent legally permissible.

e. Management of UGC: Ungjin reserves the right to review, monitor, and manage UGC on ungjin.net. Ungjin may reject, delete, move, or modify UGC at Ungjin’s discretion, especially if it is offensive, inappropriate, or infringes on the rights of others. Ungjin is not obligated to maintain, store, or provide access to any UGC submitted.

f. Representations and Warranties Related to Your UGC: When you submit UGC, you represent and warrant that you have the right to submit it and grant the licenses herein, that it is accurate, does not infringe on any rights, and does not violate any laws or these Terms.

g. Enforcement: While Ungjin has no obligation to monitor or enforce your Intellectual Property rights in your UGC, you grant Ungjin the right to protect and enforce our rights to your UGC, including initiating actions on your behalf.

h. Community Guidelines: Ungjin may issue guidelines for participating in any online communities on ungjin.net. Your participation is subject to these guidelines and all other Terms. Ungjin reserves the right to take action against UGC that violates these Terms or guidelines, but Ungjin is not obligated to take any action not required by law.


6. Intellectual Property Rights and Infringement Policy

a. General: In response to any notification of alleged intellectual property infringement, Ungjin may, at Ungjin’s sole discretion, remove the content in question, prohibit users from posting on ungjin.net, and cancel user registrations. The sole liability in such cases will be the refund of any remaining balance of a user's subscription fee, if applicable. For alleged copyright infringement, Ungjin will act in accordance with relevant South Korean intellectual property laws and take steps to remove or block access to the allegedly infringing material.

b. Procedure for Submitting Notification of Alleged Copyright Infringement: It is Ungjin’s policy to respond to notices of alleged copyright infringement in compliance with applicable laws. Subscribers should choose a unique and personal identifier that is respectful and does not infringe on the rights of others. I reserve the right to reject any subscriber details at my discretion. It is important to keep your subscription information updated and to promptly notify me of any unauthorized use of your subscription or security breaches. Subscriptions are personal and should not be sold, transferred, or assigned. They should be obtained by individuals who are of legal age and represent themselves accurately. While I do not individually authenticate each subscription, I reserve the right to resolve any disputes or issues regarding subscription authenticity or misuse in a manner I deem appropriate.

b. Wireless Features: The Service may include features accessible via mobile devices, including uploading content, receiving messages, and downloading applications (“Wireless Features”). By using these features, you consent to receive communications sent through them. Your usage of Wireless Features may be tracked. If you register for Wireless Features, update Ungjin with any changes to your contact information. You may receive notifications, including pop-up messages, which might be delivered even when the Service is not actively running on your device. You are responsible for managing these notifications in your device settings. Ungjin makes no representation that the Service is appropriate or available for use outside South Korea. Using the Service from other locations is at your own risk and you are responsible for compliance with local laws.

d. Text Messaging: If you provide your mobile phone number, Ungjin may ask for your consent to send text messages containing information about products, events, or promotions (“Text Messages”). Opting into Text Messages is not a requirement for purchasing goods or services. The frequency of messages varies and may be based on your interaction with the Service. Message and data rates may apply, and carriers are not liable for delayed or undelivered messages. To unsubscribe from Text Messages, reply “STOP” to a received message. 8. Subscriptions and Donations

Welcome to the exclusive subscription offerings on ungjin.net! Our subscription plans, ranging from 'Snack Time Supporter' to 'Ultimate Feast Lord,' offer various perks and are designed to foster a closer connection while supporting my creative endeavors. Each plan, from $5 to $135 a month, provides unique benefits, like personal calls, special event invitations, and private meetings. By subscribing, you join a special circle of supporters who play a pivotal role in Ungjin's creative journey.

b. PayPal Subscription Process: 

All subscriptions on ungjin.net are processed through PayPal. Here’s what you need to know:

Automatic Payments: Your chosen PayPal account is billed monthly for the selected subscription.

Billing Cycle: Initial charges occur upon subscription, with subsequent charges on the same date each month.

Payment Authorization: By subscribing, you authorize recurring charges through PayPal until you cancel.

Manage or cancel your subscription anytime via your PayPal account. Remember, to avoid next month's charge, cancel before 11:59 p.m. Central time on the day before your subscription renews.

d. Subscription Renewal and Cancellation: 

Subscriptions automatically renew each month. You may cancel any time before the renewal date to prevent future charges. Cancellations take effect at the end of your current billing cycle.

e. Price Changes and Free Trials:

Prices may change, but I'll provide 30 days' notice before any increase. Some plans may start with a free trial, billed at the conclusion unless canceled.

f. Promotions and Refunds:

Promotional codes apply to specific periods and not to renewals. While all subscription purchases are final and non-refundable, I reserve the right to issue refunds at my discretion in exceptional circumstances.

g. Chargeback Policy:

Issuing chargebacks for uncancelled subscriptions is prohibited. Engaging in this may result in subscription termination.

9. Indemnification

In accordance with applicable law, you agree to defend (if requested), indemnify, and hold harmless Ungjin from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from or related to: (a) your content or contributions; (b) your use of the Service; (c) breach of these Terms; (d) violation of any laws in connection with your use of the Service; (e) information transmitted from your device infringing any right of a third party; (f) any misrepresentation made by you; and (g) use of your information as per our Privacy Policy. You will fully cooperate in the defense of such claims. Ungjin retains the right to control the defense and settlement of any claim, and you will not settle any claim without Ungjin’s prior written consent. This section does not limit any non-waivable rights.


10. Disclaimer and Limitation of Liability

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS” BASIS. To the fullest extent permissible under Korean law, Ungjin disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Ungjin makes no representations about the quality, correctness, accuracy, or reliability of the Service. Ungjin does not warrant that the Service will be uninterrupted or error-free, or that defects will be corrected. This disclaimer does not affect any warranties which cannot be excluded or limited under applicable law.


11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNGJIN SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, REVENUES, OR SAVINGS, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF UNGJIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR DAMAGES.


12. Dispute Resolution

Any dispute arising out of these Terms, the Service, or our relationship shall be resolved through binding arbitration in accordance with the Korean Commercial Arbitration Board (KCAB) rules. The arbitration shall be conducted in Seoul, South Korea, by a single neutral arbitrator. The arbitration shall exclude indirect, punitive, special, or consequential damages. Each party bears its own legal fees and costs, but an arbitrator may award legal fees as deemed appropriate. Arbitration claims must be made within a reasonable time, not exceeding one year from when the aggrieved party knew of the basis for the dispute. No class or representative actions are permitted. Judgment on the arbitration award may be entered in any court with jurisdiction. This arbitration agreement is governed by the Korean Arbitration Act. This section can only be amended by mutual agreement. Either party may seek enforcement in any court of competent jurisdiction. The arbitrator will decide the arbitrability of any claim.



13. General Provisions

a. Governing Law: These Terms, any additional terms, disputes, and any other claims related to the Service, content, or other services provided by Ungjin will be governed by, construed, and resolved in accordance with the laws of the Republic of Korea, without regard to conflicts of law principles.

b. No Waiver: Any failure on Ungjin’s part to enforce strict performance of any provision of these Terms will not constitute a waiver of Ungjin’s right to subsequently enforce such a provision or any other provision of these Terms. Neither delay nor omission by Ungjin in exercising any right or remedy hereunder shall operate as a waiver of any right or remedy.

c. Severability: If any provision of these Terms is found invalid or unenforceable by a court or other tribunal of competent jurisdiction, the remaining provisions will continue in full force and effect. Any unenforceable provision will be modified to the extent necessary to make it enforceable while maintaining the intent of the original terms.

d. Modification: Ungjin reserves the right, in Ungjin’s sole discretion, to update, revise, supplement, and otherwise modify these Terms and to impose new or additional rules, policies, terms, and conditions on your use of the Service from time to time. Such changes will be effective immediately upon posting. You are encouraged to review these Terms upon each visit to the Service. If a change is material, Ungjin will also provide at least thirty (30) days' advance notice. This notice may include posting on the Service or sending notifications to the email address associated with your account. Your continued use of the Service following such notice will indicate your acceptance of the revised Terms.

e. Privacy Policy: All information collected on the Service is subject to Ungjin’s Privacy Policy. By using the Service, you consent to all actions taken by Ungjin concerning your information in compliance with the Privacy Policy.

Investigations; Cooperation with Law Enforcement; Termination; Survival: As permitted by applicable law, Ungjin reserves the right to investigate any suspected breaches of Service security, these Terms, and any applicable additional terms. Ungjin may use information obtained in connection with reviewing law enforcement databases or complying with legal requirements and disclose such information to comply with law enforcement requests in accordance with our Privacy Policy. Ungjin will cooperate with law enforcement authorities in investigating these matters, prosecute violators, and may discontinue or limit your access to the Service at any time, without notice, for any reason. Any suspension or termination will not affect your obligations under these Terms. Upon suspension or termination, all rights granted to you under these Terms will cease immediately, and you agree to discontinue use of the Service.
